COREHABIT TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of CoreHabit.fit and the fitness, nutrition, membership, apparel, e-commerce, and related products and services offered by CoreHabit (“CoreHabit,” “we,” “us,” or “our”).

By accessing or using CoreHabit, creating an account, purchasing a membership, or purchasing a product, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

1. CoreHabit Services

CoreHabit provides fitness and wellness-related services that may include:

2. Fitness and Medical Disclaimer

CoreHabit provides general fitness, nutrition, and wellness information for educational and informational purposes only.

CoreHabit is not a medical provider, healthcare provider, registered dietitian, physical therapist, or substitute for professional medical advice.

The Services are not intended to diagnose, treat, cure, or prevent any disease, injury, or medical condition.

You should consult an appropriate healthcare professional before beginning a new exercise program, substantially changing your diet, or following fitness or nutrition recommendations, particularly if you have a medical condition, injury, dietary concern, are pregnant, take medication, or have other health concerns.

If you experience pain, dizziness, fainting, shortness of breath beyond normal exercise exertion, chest pain, or other concerning symptoms, stop exercising and seek appropriate medical attention.

You are responsible for determining whether exercises, foods, recommendations, and activities are appropriate for you.

3. No Guaranteed Results

Fitness and nutrition outcomes differ between individuals.

CoreHabit does not guarantee:

Results may depend on numerous factors outside CoreHabit's control, including consistency, nutrition, sleep, genetics, health, training history, lifestyle, and adherence.

Testimonials, examples, or results displayed through CoreHabit do not guarantee that you will achieve the same or similar results.

4. Personalized Recommendations

CoreHabit may generate recommendations based on information you provide.

You are responsible for providing accurate information and exercising reasonable judgment when following recommendations.

Automated or personalized recommendations may contain errors or may not account for every circumstance relevant to you.

You should not rely on CoreHabit for emergency, medical, diagnostic, or treatment decisions.

5. Accounts

Certain features require a CoreHabit account.

We may suspend or terminate accounts that violate these Terms, misuse the Services, engage in fraud, interfere with CoreHabit systems, or create security risks.

6. CoreHabit Membership

CoreHabit may offer a paid membership providing access to additional fitness and nutrition features.

The current membership price displayed at checkout will control your purchase. CoreHabit may currently offer membership at $9.99 per month or $79.99 per year, subject to change for future purchases. Yearly memberships are billed once a year in advance and renew each year until cancelled. Members who switch from monthly to yearly are charged the yearly price, minus a credit for the unused part of their current month.

Before completing a purchase, you will be shown the applicable price and billing terms.

7. Automatic Renewal

Unless otherwise stated during checkout, CoreHabit memberships automatically renew at the applicable billing interval until cancelled.

By purchasing an automatically renewing membership, you authorize our payment processor to charge the applicable membership fee and any legally required taxes to your selected payment method on a recurring basis until cancellation.

You are responsible for maintaining a valid payment method.

8. Membership Cancellation

You may cancel your CoreHabit membership through available account or billing-management features or by contacting support@corehabit.fit if account-based cancellation is unavailable.

Unless otherwise required by law, cancellation generally prevents future renewal charges rather than retroactively refunding previous membership periods.

You will ordinarily retain applicable membership access through the end of the period for which you have already paid.

9. Membership Refunds

Except where required by applicable law or expressly stated otherwise at checkout, membership charges are generally non-refundable once a billing period has begun.

If you believe you were charged incorrectly, contact support@corehabit.fit so we can review the transaction.

Nothing in this section limits refund or cancellation rights that cannot legally be waived.

10. Pricing Changes

CoreHabit may change membership prices in the future.

Price changes affecting existing recurring memberships will be handled with any notice required by applicable law.

Continued use of a membership after a properly communicated pricing change and its effective date may constitute acceptance of the new price where permitted by law.

11. Apparel and Physical Products

CoreHabit may sell apparel, accessories, and other physical products through CoreHabit.fit.

We attempt to display products, colors, sizes, descriptions, availability, and pricing accurately. However, screen settings, photography, manufacturing variation, and other factors may cause products to appear somewhat different in person.

Products may be available in limited quantities.

Placing an item in a shopping cart does not guarantee availability.

An order is subject to acceptance and product availability. Limited releases and apparel launches may sell out without notice.

Shipping prices, available methods, estimated delivery windows, and applicable restrictions will be displayed during checkout or elsewhere on CoreHabit.fit.

Delivery dates are estimates unless expressly guaranteed.

CoreHabit is not responsible for delays caused by carriers, weather, customs, incorrect customer information, events outside our reasonable control, or other circumstances beyond our control, subject to applicable law.

Customers are responsible for providing an accurate and complete shipping address.

14. Returns and Exchanges

Return and exchange eligibility for apparel and physical products will be governed by the return policy displayed on CoreHabit.fit at the time of purchase.

Certain products may be final sale, including products identified as final sale and other items that may legally be excluded from returns.

Nothing in our return policy limits rights that cannot be waived under applicable law.

Payments may be processed through third-party payment providers such as Stripe.

By providing payment information, you represent that you are authorized to use the payment method provided and authorize applicable charges associated with your purchase.

You are responsible for applicable taxes, shipping charges, and other amounts disclosed before purchase.

You may not resell, redistribute, commercially reproduce, systematically copy, or make CoreHabit membership content publicly available.

CoreHabit is not responsible for independent third-party services or websites outside our reasonable control.

We work to keep CoreHabit available and functional, but we do not guarantee uninterrupted or error-free access.

The Services may occasionally be unavailable because of maintenance, updates, technical failures, third-party outages, security issues, or circumstances outside our control.

We may modify, discontinue, replace, or introduce features over time.

Exercise and physical activity involve inherent risks, including the possibility of injury.

By voluntarily participating in exercise or activities suggested through CoreHabit, you acknowledge the inherent risks associated with physical activity and accept responsibility for exercising within your abilities, subject to rights and liabilities that cannot legally be waived.

23. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

COREHABIT DISCLAIMS WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COREHABIT AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

COREHABIT'S LIABILITY WILL NOT BE LIMITED WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

25. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless CoreHabit and its affiliates, owners, employees, and representatives from third-party claims arising from your unlawful misuse of the Services or material violation of these Terms.

Your use of CoreHabit is also subject to our Privacy Policy, which describes how we collect, use, and protect information.

27. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

28. Changes to These Terms

CoreHabit may update these Terms periodically as the Services, business, or applicable laws change.

The “Last Updated” date will identify the latest revision.

Where required by law, we will provide appropriate notice of material changes.

Continued use of the Services after updated Terms become effective constitutes acceptance where permitted by applicable law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

30. Entire Agreement

These Terms, together with applicable policies and terms presented during purchases or use of particular CoreHabit features, constitute the agreement between you and CoreHabit regarding the Services covered by them.
